Our client’s journey began in 2001 when he entered the United States on a B1 visa from Pakistan.
His early attempts to secure residency were fraught with challenges.
His ex-wife initially petitioned for his I-130, Petition for Alien Relative, but it was denied due to his failure to appear at the scheduled Stokes Interview.
Consequently, he was issued a Notice to Appear and was ordered removed in March 2010.
In 2011, our client went through a difficult divorce.
However, his life took a positive turn when he met his current wife in 2018.
They married in 2019, and she submitted an I-130 petition on his behalf in September 2019.
This petition was approved in September 2022, but his concurrent application for adjustment of status was administratively closed due to lack of USCIS jurisdiction.
Determined not to give up, our client sought our assistance to navigate the complex immigration process.
We worked closely with him to prepare a robust Prosecutorial Discretion (PD) Request for ICE/DHS to join in our Motion to Reopen and Dismiss his removal proceedings.
This included providing hardship documents for his United States Citizen spouse, who could not work due to a medical condition, and evidence of his good moral character.
Our submission included a heartfelt statement from his wife, her medical documents, and our client’s medical records.
In February 2024, we submitted the Prosecutorial Discretion Request.
Just four short months later, in June 2024, we received the fantastic news that ICE/DHS agreed to join our motion.
This swift response is particularly noteworthy, given that, according to their own policy, the typical processing time for motions to reopen in New York is between 9 and 12 months.
This victory is a testament to the resilience of our client and the relentless efforts of our team.
