Originally from Haiti, she entered the United States on a visitor visa in November 2005 and remained in the country after her visa expired, later applying for Temporary Protected Status (TPS) in 2010.
With no criminal record and no past attempts to secure permanent residency, her situation seemed promising when her U.S. citizen mother filed an immigrant visa petition on her behalf, which was approved.
However, in a twist of fate, when the National Visa Center (NVC) issued a welcome letter indicating that a visa number was available, the family mistakenly submitted an Adjustment of Status application to USCIS in May 2020, only to face denial in October due to her previous overstay.
In November 2020, she sought our guidance. We advised her on the necessary steps to initiate the consular process and obtain an I-601A waiver to address her unlawful presence in the United States. Because she was an adult who overstayed her visa, she was ineligible to adjust her status through her U.S. citizen mother.
In January 2021, we submitted a robust I-601A provisional waiver package, emphasizing the significant hardship her elderly mother faced without her support. The evidence included details about her mother’s advanced age, glaucoma and cataract surgeries, high blood pressure, arthritis, and reliance on her for care.
After patiently waiting through the lengthy review period, she received the long-awaited approval of her I-601A waiver in June 2025! This pivotal approval paved the way for her immigrant visa interview at the U.S. embassy abroad.
After her embassy interview, she will have the long-awaited peace of mind knowing that she will remain permanently in the United States with her family.
