I-130 Approved for Our Ghanaian Client in Removal Proceedings 

We are thrilled to share the fantastic news that our Ghanaian client’s I-130 petition has been approved while he is in removal proceedings.

This approval is a significant step forward in his journey towards legal permanent residency in the United States.

Our client’s story began when he arrived in the United States in April 2015 and applied for asylum.

Unfortunately, in March 2016, he was ordered removed and has since been in removal proceedings.

Despite these challenges, he continued to build a life here, including finding love and starting a family.

At his consultation, we found out that our client and his wife first got married in a religious ceremony in 2019, followed by a civil ceremony in March 2021.

His wife, a Legal Permanent Resident, petitioned for him, but because he was already in removal proceedings, we needed to prove that their marriage was bona fide with a higher burden of proof – clear and convincing evidence.

After we filed, his wife applied for naturalization and became a U.S. citizen.

To demonstrate the authenticity of their relationship, we submitted a wealth of documentation, including a detailed history of their dating relationship, joint bank account statements, photos of the couple together, social media posts, letters of support from friends and family and evidence of their two children together.

Given that the marriage occurred while our client was in removal proceedings, we also submitted a bona fide marriage exemption request.

This required us to show, by clear and convincing evidence, that the marriage was genuine.

Thanks to the comprehensive evidence we provided, we successfully met this higher burden of proof.

We filed the I-130 petition back in December 2021 under the F2A category as spouse of a legal permanent resident.

Since his wife eventually became a U.S citizen, the approval also enables us to file a Prosecutorial Discretion (PD) request to reopen and terminate his removal proceedings, which is a crucial step in securing his permanent residency.

This approval is a testament to the perseverance of our client and the diligent work of our legal team.

This success story shows the importance of thorough preparation, the gathering of robust evidence, and the belief in our client’s right to build a life and family in the United States.
