Our client’s story began in 2000 when she arrived in the United States seeking a better life.
Without a visa, she entered the country by boat near Miami, Florida and soon applied for political asylum.
Unfortunately, her asylum application was denied, and she found herself in removal proceedings.
Unfortunately, she was ordered removed by the immigration judge.
Despite this setback, she remained steadfast in her pursuit of the American dream.
During these challenging times, she met and married a U.S. citizen who has been her constant supporter.
Together, they have built a family, raising two wonderful children who are U.S. citizens by birth.
Her husband, however, has faced serious health challenges, including heart problems that required a pacemaker and a recent battle with cancer.
Throughout his health struggles, she has been the primary caregiver and breadwinner for the family.
In 2010, she was granted Temporary Protected Status (TPS), which allowed her to live and work legally in the U.S.
She diligently maintained her TPS for over a decade without any gaps.
In 2017, she had the opportunity to travel abroad and return to the U.S. under advance parole, which granted her a lawful entry —a crucial factor in her immigration journey.
Her husband filed an I-130 Petition for Alien Relative on her behalf, which was approved.
However, when she applied for adjustment of status with Form I-485, her application was denied.
The denial was based on complex jurisdictional issues stemming from her outstanding removal order.
Recognizing the complexities of her case, she scheduled a consultation with us in February 2022.
We stepped in to provide the legal support she needed.
In July 2022, we filed a request for prosecutorial discretion to reopen and terminate her removal proceedings.
We emphasized her strong family ties, her role as the primary caregiverfor her ailing husband, and her continuous contribution to the community.
Her husband’s medical records and the family’s circumstances were critical in illustrating the humanitarian factors at play.

Her removal proceedings were reopened and ultimately terminated,clearing a significant hurdle in her path to permanent residency.
In February 2024, we filed a new I-485 application for adjustment of status.
Just seven months later, in September 2024, we received the wonderful news: her application was approved.
After 24 years of uncertainty, she is now a proud green card holder—a lawful permanent resident of the United States.
