The team at McBean Law is excited to share another inspiring story about our Mexican client who went from DACA to lawful permanent residency after years of immigration uncertainties.
Our client entered the U.S. around June 1999, returned to her home country of Mexico in 2001, and subsequently re-entered the U.S. in 2002. However, she re-entered without inspection, and this unlawful entry became a major stumbling block in her immigration journey. Years later, she applied for DACA and was able to obtain a temporary lawful status through that program. She maintained her DACA status before marrying a U.S. Citizen in 2015.
Although her marriage to a U.S. Citizen was a significant turning point in her journey, it did not solve her immigration problems. Because she did not have proof of being inspected and admitted or paroled into the country by Customs and Border Protection, she was ineligible for adjustment of status. Her only option was to apply for a waiver and finish the green card process at the U.S. embassy in Mexico.
However, she was determined to obtain her green card inside the U.S. and consequently, she decided to wait several years until an opportunity opened up for her to do so. When she came to us in 2022 to discuss her pathway to residency through adjustment of status, we advised her that she will need entry records showing lawful inspection and admission. She informed us that her paternal grandmother in Mexico was ill and she wanted to visit her as soon as possible.
Our firm prepared an Advance Parole application for her to obtain a travel document to leave and return to the U.S. Heartbreakingly, her grandmother ended up on life support just two months afterward. We guided the client on how to obtain an emergency advance parole, and she was successful in doing so. She was able to travel and return to the U.S. lawfully.
We then used her new entry records to prepare an adjustment of status application for her! Her case was submitted in March 2023 and approved in May 2024 without an interview!
