After 30 Years of Uncertainty, I-601A Waiver Approved for Filipino Client

She first came to the U.S. in September 1993 on a fiancé visa, but due to unforeseen complications, she did not marry the original petitioner. Her husband filed an I-130 petition on her behalf, which was approved. In September 2021, she received her NVC case creation letter instructing her to move forward with the consular process. But with decades of unlawful presence in the U.S., she faced a significant hurdle: she could not proceed without first obtaining a waiver of inadmissibility.

In September 2023, our team filed her I-601A provisional waiver, presenting strong evidence of the extreme hardship her U.S. citizen husband would face if she were forced to leave. We highlighted his medical conditions, his dependence on her caregiving, and the emotional toll separation would cause. 

On September 9, 2025, her I-601A waiver was approved! With this major milestone achieved, she can now move forward to the final step: completing her immigrant visa process at the U.S. Embassy in Manila, Philippines. 

After more than 30 years of uncertainty, she and her husband now have hope for stability and security together.
