Our Client’s Story
Our client came from Haiti to the U.S. in 2001 with a visitor’s visa and applied for asylum shortly thereafter.
Unfortunately, her asylum case was denied and she was placed in removal proceedings as a result. An immigration judge issued a removal against her in early 2004.
She then married a U.S. citizen and he tried to help her fix her status by filing his Form I-130 in 2012, which was subsequently approved. Prior to this, she had obtained TPS (Temporary Protected Status) when it became available for Haitian nationals in 2010.
Now, her lawyer at the time prepared a motion to reopen her removal proceedings and filed it with the immigration court, but it was denied in 2018. At the advice of that lawyer, she left the U.S. with the Advance Parole available through her TPS, although there really was no need to do that regardless of her removal order. She came back just a month afterwards, and her lawyer advised her to apply for Adjustment of Status and submit her Form I-212, the waiver. She did so, and both were denied.
But, despite all of these denials, she didn’t give up. She didn’t lose hope, but there was a long gap, so to speak, from the time of her last denial until she came to meet with us.
After doing an extensive case assessment, we prepared her joint motion to reopen and terminate her removal case. This was submitted to the ICE field office in mid-2023. It was approved just a few days afterwards! With this fix, we can work on her Adjustment of Status.
