Our client’s immigration journey from Haiti to the United States has been extraordinary. After being charged with fraud and misrepresentation, his pursuit of Temporary Protected Status (TPS) seemed uncertain.
Our client’s story began in 1986 when he gained permanent resident status through a petition by his ex-spouse.
After leaving the U.S. in 1994 to attend his father’s funeral in Haiti, he returned to the U.S. only to discover he was being placed in Immigration Court! He learned that his ex-spouse was married to someone else at the same time of being married to him. Our client, being unaware and having no knowledge of the double life his ex-spouse was living, was in a state of confusion and uncertainty.
Unfortunately, he lost his removal case, and in 2003, an Immigration Judge ordered him removed from the country.
His current U.S. citizen wife of 27 years filed a green card petition for him. However, his case was denied due to the alleged bigamy on his record.
In June 2022, he applied for TPS to be able to remain in the United States and obtain work authorization.
In August 2023, he received a Request for Evidence stating that he was inadmissible because of his alleged involvement in a bigamous relationship, and without a waiver, his TPS application would be denied.
Being afraid but unwilling to give up, our client sought our assistance to prepare a waiver in his case. The waiver gave our client an avenue to waive his ground of inadmissibility and ultimately receive his Temporary Protected Status.
Our legal team showed that not only should our client be eligible to receive TPS, but that there was no fraud and/or misrepresentation to begin with since he had no knowledge that his ex-spouse was married to someone else while they were both married to each other. We provided substantial evidence to persuade USCIS to approve the waiver.
In November 2023, we responded to his Request for Evidence. Our compelling evidence and work triggered an immediate response from USCIS!
In December 2023, they granted his waiver application and ultimately his TPS! With his TPS approval, our client can now turn his attention to supporting his family and being able to remain here in the United States.
