Our client’s journey began with an unfortunate setback: her previous attorney claimed to have filed a Prosecutorial Discretion request on her behalf, but it was later discovered that this crucial step was never taken.
When she came to us, we knew immediate action was required.
We started by filing a FOIA request to obtain her records and carefully assess her situation.
Upon reviewing her case, we uncovered a 2007 removal order and a significant complication—her asylum case had been denied due to adverse credibility findings.
Despite her appeal, which she argued was based on a misunderstanding, the Board of Immigration Appeals (BIA) ultimately denied her appeal in 2009.
This adverse decision posed a serious challenge, but it did not deter us from fighting for her future.
Recognizing the gravity of her situation, we prepared a robust Prosecutorial Discretion request to reopen and terminate her removal proceedings.
We built our case on the strength of her approved spousal I-130 petition and her lawful status under Temporary Protected Status (TPS).
Our submission included comprehensive evidence of her good moral character, such as letters of support, professional certificates, proof of employment, tax transcripts, and FBI/police background checks.
Our client, who is married to a U.S. citizen and a devoted mother of four children, had her family’s well-being at the forefront of her mind throughout this process.
We filed the Prosecutorial Discretion request in January 2024, and our efforts were rewarded when the ICE/DHS agreed to join the Motion to Reopen and Dismiss her removal proceedings in August 2024.
Our client is now a step closer to being a permanent resident of the United States!
