How does a young life find legal stability after being abandoned and losing their only parent?
For our client from the Bahamas, who was born in 2007, his journey became complex after his mother passed away in September 2024. His father abandoned him when he was just four months old. The minor, who entered the U.S. in June 2021, was left in the care of his aunt.
Years of Instability and Legal Uncertainty
His aunt reached out to our firm in April 2025 to discuss how she may help her nephew obtain lawful status in the US. We advised her to pursue a legal guardianship and predicate order for Special Immigrant Juvenile Status (SIJS) in New Jersey.
SIJS is a special legal path that helps children in the U.S. who have been abused, abandoned, or neglected by one or both parents. If a judge says it is not safe for the child to go back to their home country, this status allows them to apply for a Green Card so they can live safely and legally in the United States.
Our Legal Strategy
Our attorney represented the aunt in Family Court and had to coordinate international service of process to notify the father in the Bahamas. We located the father, and he agreed to cooperate.
However, Bahamian law did not allow voluntary forfeiture of parental rights. Therefore, we proceeded with formal service, prepared an Affidavit of Service, and ensured all documentation was completed properly. Proof of service with notarization and apostille was arranged for court submission.
The Final Victory
In October 2025, the New Jersey Family Court granted the Predicate Order, officially recognizing the aunt as the minor’s legal guardian. The court found the minor qualified for SIJS classification as he is under 21, unmarried, and has been granted custody to his aunt. The judge also determined that it is not in the best interest of the minor to be returned to the Bahamas given his abandonment and lack of parental care.
This approval cleared the way for filing the I-360 Special Immigrant Juvenile petition with USCIS, a pathway to lawful permanent residency.
