What happens when your path to building a family in the United States is filled with setbacks and uncertainty?
For our client from Jamaica, that question was all too real. Their first attempt to come to the U.S. on a B2 visitor visa was denied, and a previous spousal petition filed on their behalf was never completed. Despite these obstacles, they remained committed to building a life with their U.S. citizen fiancé.
In May 2023, they successfully entered the U.S. on a K-1 fiancé visa following an interview in Kingston. They married in Chicago in July 2023, and though they share a child together, the client’s name was not on the birth certificate because they were not present at birth. Life had its challenges, and the couple experienced periods of living apart, but they eventually reunited and are now living together as a family in the U.S.
They first consulted with McBean Law in September 2023 to plan the adjustment of status process. Our team filed the adjustment of status, employment authorization, and travel authorization applications in October 2024. During the process, USCIS issued an erroneous RFE questioning the Affidavit of Support, even though the petitioner met all income requirements. We responded promptly and clarified the error.
In May 2025, the couple attended their green card interview at the USCIS Atlanta Field Office, presenting strong evidence of a bona fide marriage. After months of anticipation, the client’s adjustment of status was approved in August 2025, granting lawful permanent resident status.
Today, the client and their family can move forward with stability and peace of mind, having overcome prior denials and delays to achieve their American dream.
