What if the dream of citizenship and family unity seemed just out of reach due to unforeseen obstacles?
This was the reality for our client, who displayed incredible determination throughout his journey. Hailing from Mauritania, he came to us in 2022 after receiving a notice indicating that USCIS intended to deny his N-400 naturalization application.
Despite having been granted asylum in 2013 and successfully passing the naturalization exam, he faced a challenge when the officer required additional evidence concerning his financial support for his U.S. citizen child from a previous relationship.
At that time, he was still married but living separately from his wife, who was residing in North Carolina with their three-year-old child. As a truck driver based in New York, he was committed to demonstrating his active role in his family’s life.
We assisted him in filing Form N-336 (Request for Hearing) to contest the denial of his naturalization case and helped him compile additional documentation that highlighted his ongoing involvement with his child. His efforts were rewarded when his N-400 application was ultimately approved, granting him U.S. citizenship.
With his new status, he was able to file an I-130 petition for his wife, a Jamaican national who entered the U.S. on a P-3 visa in 2018 as an entertainer but later overstayed her visa. In January 2025, we submitted both the I-130 and I-485 (adjustment of status) applications for her.
Even though his income surpassed the necessary guidelines, USCIS issued a Request for Evidence regarding the Affidavit of Support. We swiftly addressed this request with updated financial documentation. Additionally, we applied for a work permit (Form I-765) for his wife, which was approved in April 2025.
To prepare them for their interview, we conducted a mock session and accompanied them to their USCIS interview in July 2025 at the Queens Field Office. The interview went smoothly, and her green card was granted the following day.
Thanks to the successful naturalization and adjustment processes, our client is now a U.S. citizen, and his wife has become a lawful permanent resident. Together, they are united and building their life in the United States.
