Haitian Client is Free from Deportation After Court Ends His Long Pending Removal Case

When a removal case has been sitting in immigration court for years, it can block a person from moving forward. 

Our client is a citizen of Haiti who entered the United States in July 1995.

At the time of entry, he used fraudulent travel documents to gain admission to the United States.

He was later placed in removal proceedings before the immigration court.

During the course of those proceedings, the case was administratively closed after he obtained Temporary Protected Status (TPS).

While the removal case remained administratively closed, our client continued building a life in the United States with family.

In March 2020, his U.S. citizen daughter filed an I-130 Petition for Alien Relative on his behalf.

That I-130 petition was approved in 2021, establishing a qualifying family relationship for immigration purposes.

However, even with an approved I-130 petition, he could not move forward with the next steps toward lawful permanent residence because the removal case was still technically pending in immigration court in an administratively closed posture.

He then came to McBean Law for a full case assessment and strategic review of the immigration history.

After reviewing his record, in April 2025, our legal team filed a Motion to Recalendar and Terminate the administratively closed removal proceedings.

In our motion, we explained our client’s long residence in the United States, the approved immigrant petition filed by his U.S. citizen daughter, and the history of the removal case. We asked the New York immigration court to recalendar the matter and terminate proceedings so that he could pursue adjustment of status with USCIS.

In February 2026, the immigration court granted the motion and terminated the removal proceedings!

This outcome removed a major legal barrier that had been preventing our client from moving forward with the immigration process.
