Our client and his wife first reached out to our firm in March 2023 to seek assistance with his spousal adjustment of status application.
The case was not straightforward, and as we prepared their filing, we also submitted a Freedom of Information Act (FOIA) request to USCIS to retrieve his records.

The client’s journey started with his adoption in Morocco.
Unfortunately, when he arrived in the U.S., his adoption was viewed as a guardianship.
His adoptive mother was required to go through the adoption process again under U.S. laws.
She petitioned for him, but by the time the adoption was completed, he was over 16—the age limit for adoption petitions under U.S. immigration laws.
This led to a denial, and when his adoptive mother appealed, the Board of Immigration Appeals (BIA) upheld the decision.
Our client then married his now ex-wife, who filed an I-130 petition on his behalf.
After attending their USCIS interview, they received a Notice of Intent to Deny (NOID).
Despite their efforts to respond, USCIS denied their application.
In 2022, our client met his current spouse, and they tied the knot in 2023.
Understanding that the previous NOID and denial could affect this new application, our legal team worked meticulously to prepare a thorough, well-documented adjustment of status submission.
We filed a robust packet with USCIS, totaling around 400 pages of evidence.
We submitted both the I-130 Petition for Alien Relative and the I-485 Application to Register Permanent Residence or Adjust Status in September 2023.
The couple attended their interview in July 2024, and on July 30, 2024, the USCIS Officer called with great news—the application was approved!
After years of uncertainty and navigating a complex immigration history, our client is finally a lawful permanent resident.
