Navigating the complexities of immigration law can be daunting, but our firm prides itself on finding solutions even in the most challenging circumstances.
Recently, we had the privilege of assisting a Jamaican client whose journey shows the resilience and perseverance that defines our approach.
Our client came to us with a troubling history.
She had initially obtained lawful permanent residency (LPR) through marriage.
However, less than five years into her residency, she was convicted of credit card fraud, which is a crime involving moral turpitude (CIMT).
Unaware of the immigration consequences of her conviction, she applied for naturalization a few years later, and her case was subsequently denied.
This denial placed her in removal proceedings due to the conviction of a CIMT.
Our client’s attempts to seek asylum as a defense in removal proceedings were unsuccessful.
She lost her residency status after the revocation of her green card.
She came to us at this critical juncture in her immigration journey.
Our lead attorney took a close look at her case, determined to find an alternative pathway to regain residency.
We requested Freedom of Information Act (FOIA) records from multiple government agencies to gather essential information.
During our investigation, we discovered that our client was eligible for a U visa, designed for victims of certain crimes who have suffered substantial mental or physical abuse and are willing to assist law enforcement.
Our client was a victim of sexual misconduct.
She met a man who promised her a job in maid services but instead subjected her to sexual harassment and exploitation.
Despite the trauma, our client courageously reported the incident to authorities and cooperated fully with their investigations, thus meeting the U visa eligibility criteria.
In April 2024, we submitted our request to the appropriate law enforcement agency for their certification of the case.
To our delight, it was was certified by June 2024!
With the certification secured, we are now proceeding with the U visa application for our client.
This visa not only offers temporary relief but also paves the way for her to regain permanent residency status in the future.
Our dedication to her case and our willingness to explore every possible avenue has given our client a renewed hope for a stable and secure future.
At our law firm, we believe that every client deserves a comprehensive and compassionate approach to their unique legal challenges.
This case exemplifies our commitment to seeking justice and providing innovative solutions in the face of adversity.
