After Three Years in Removal Proceedings, Jamaican Asylum Seeker Wins His Case in New York Without Objection from ICE

Have you fled your home country because of persecution and fear for your life, unsure if the U.S. will grant you protection? The asylum process can be long and uncertain, but with the right legal team, justice is possible.

One of our recent clients from Jamaica endured a lifetime of persecution. As a gay man, he faced relentless violence and discrimination in his home country. On top of that, his family was associated with one of Jamaica’s most dangerous gangs—despite his own non-involvement. Because of this, he became a target

His close family members were murdered by rival gang members. The murderers also made direct death threats against our client. He was physically assaulted in 2006 due to his perceived homosexuality and was chased and attacked multiple times over the years by gang members. Even after escaping to the U.S., the threats against him continued.

Fearing for his life, he entered the U.S. at the Mexico border in 2022 without inspection. He was detained briefly before being placed in removal proceedings. Charged with removal that same month, he faced deportation back to the life-threatening conditions he had barely escaped.

Determined to fight for his right to stay, he turned to McBean Law, a trusted New York-based immigration law firm with experienced attorneys who specialize in asylum cases.

In July 2022, our firm began working on his case in preparation for his first Master Calendar Hearing (MCH) the following month. Given the gravity of his situation, we meticulously built a strong asylum claim supported by extensive evidence.

We timely filed his defensive asylum application (I-589) in 2023, ensuring that every detail of his persecution was clearly documented.

His case was supported by a comprehensive personal declaration detailing the dual bases of his asylum claim—his sexual orientation and forced familial association with gang activity. We submitted mental health records to show the psychological trauma he suffered, a timeline of past persecution and threats, and country conditions evidence.

Throughout the process, we thoroughly prepared him for his final hearing.

His hearing was scheduled for March 2025. But before that day even arrived, we received incredible news.

The Department of Homeland Security (DHS) did not oppose his asylum application! Also, the Immigration Judge in New York granted asylum on the record after reviewing his case file and documentation!

The judge even commended our team’s case preparation, noting that it was “excellently documented.”

Now, our client no longer has to live in fear. After years of uncertainty, he has won the right to remain in the U.S., safe from the threats that once controlled his life.
