Many people pursuing this green card option end up frustrated with how complicated it is. Why? Well, if you’re here in the United States and have overstayed your visa, and your sibling is a U.S. citizen, you might be thinking that this is a surefire way to get your own green card and settle down in the United States.
And then, you end up waiting for years without anything happening. This is very frustrating, especially if the sibling green card is your only pathway to a green card.
It’s even more frustrating because the sibling green card is more successful if you’re pursuing it through the consular process outside the U.S., through an Embassy in your home country. If you’re in the U.S. with an overstayed visa, you will actually have to go back to your home country and then go through the consular process. Before you leave, you’ll need an unlawful presence waiver or else you risk a 10-year ban from the United States.
Although the sibling process might be a closed door for you today, that doesn’t mean that it will always be a closed door for you. Life goes on, you can still make it.
