Our clients, a determined couple, reached out to our office for legal assistance after facing hurdles in their immigration journey.
The beneficiary, who entered the U.S. in 2016 on a visitor’s visa, had met her husband in 2019, and they married in 2022.
Her U.S. citizen husband had been married four times before marrying her, making this his fifth marriage.
Unfortunately, their first attempt to file for Adjustment of Status was denied due to a missed Request for Evidence (RFE).
Their case, submitted without evidence of a bona fide marriage, was managed by another service that failed to update their address, resulting in an RFE notice being sent to an old address.
The couple, unaware of the notice, could not respond in time, leading to a denial.
In our consultation, we advised the couple to refile with a robust set of documents to clearly establish their bona fide marriage.
In March 2024, we prepared and submitted their new application that included vital evidence of their genuine relationship.
However, our clients faced unique circumstances: they previously lived apart due to financial constraints but eventually moved in together.
They sublet a room from another tenant in a large building and, due to these unique living arrangements, had no utility bills in their names.
They also faced a second challenge: the Petitioner had filed for one of his ex wives and that case ended after he withdrew his petition.
As expected, in September 2024, USCIS requested additional proof of their good faith relationship.
Our clients gathered more evidence, and we responded to USCIS’s request (despite previously submitting more than enough evidence to win the case).
USCIS didn’t stop there, they subsequently sent our clients an Interview Notice!
When we received the Interview Notice, we embarked on a thorough and supportive interview preparation.
Our lead attorney held a detailed preparation meeting with the clients, providing them with sample questions to help ease any apprehension.
Due to the heightened scrutiny from USCIS, our managing attorney conducted a second interview prep session and accompanied the couple to the interview to advocate for them personally.
The case was approved the very next day, and our client is now a lawful permanent resident!
This success shows the importance of thorough documentation and skilled legal representation in navigating immigration processes.
