The journey began with a consultation from a concerned son in August 2023, seeking our assistance to secure his father’s immigration status in the United States.
The father, originally from Mexico, had a complex immigration history, having entered the U.S. multiple times legally on a tourist visa between 1981 and 1993.
However, due to administrative oversights, his passport was never properly stamped, complicating his legal standing.
Our team of dedicated attorneys embarked on a comprehensive legal analysis of the family’s situation, meticulously reviewing their immigration history to identify potential avenues for relief.
We requested Freedom of Information Act (FOIA) records from the U.S. Citizenship and Immigration Services and U.S. Customs and Border Protection to review our client’s immigration history.
The lead attorney determined that the most promising strategy was for the USC son to petition for Adjustment of Status (AOS) on behalf of his father.
To show his manner of entry in the United States, we presented that the father was “waived through” at the border.
This refers to an individual being allowed entry without undergoing the standard immigration procedures, such as a formal review of their entry documents.
Recognizing the critical importance of documentary evidence, we submitted affidavits from family members and friends corroborating the father’s legal entry and the family’s relationships.
These affidavits played a crucial role in building our case.
We filed the Adjustment of Status (AOS) application on behalf of the father in March 2024.
Three months later, in June 2024, our perseverance and meticulous preparation paid off— the AOS application was approved!
The approval not only secured lawful permanent resident status for the father but also brought immense relief and joy to the entire family.
It was a moment of celebration as years of uncertainty and legal challenges finally gave way to a promising future together in the United States.
