After 8 Years of Uncertainty, Haitian Client Finally Secures Green Card

Today, we’re sharing the story of our client from Haiti, who overcame significant challenges on his journey to securing a green card.

After years of uncertainty, he and his family now have the stability they’ve worked hard for.  

Our client’s journey to legal residency began in 2017 when he applied for asylum.  

Originally from Haiti, he entered the U.S. on an F2 nonimmigrant visa in 2016. By the time he sought our help, his asylum application was still pending, and he was benefiting from TPS protection. 

In 2019, he met his U.S. citizen spouse through an online dating app called Tinder. Their connection grew, leading to their engagement in 2021 and marriage in 2023

When they came to us for a marriage-based petition, we immediately began preparing the necessary documentation to support his adjustment of status application.

This included gathering evidence to prove the bona fide nature of their marriage—such as joint health insurance, bank statements, communication logs, support letters from family and friends, and photos of their life together. 

One challenge we encountered was the financial aspect. While our client was employed legally under his pending asylum status, his spouse’s income didn’t meet the federal poverty guidelines for their household size.  

To strengthen their case, we included our client’s income to help demonstrate their financial stability. 

A hurdle emerged when U.S. Citizenship and Immigration Services (USCIS) mistakenly issued a Request for Evidence (RFE) for the I-864, Affidavit of Support, despite their joint financial contributions.  

Aware that RFEs could delay or complicate the process, we advised our client to secure a co-sponsor, which he did when his sister kindly agreed to help. 

We quickly gathered and submitted the necessary documents in response to the RFE. 

Just six months after submitting the application, in January 2025, we received the exciting news: both his I-130 and I-485 applications were approved.  

This approval meant that our client no longer had to live with the uncertainty of a pending asylum case or the looming expiration of TPS for Haiti in August 2025.

With his green card in hand, he now has security in the U.S., free from the stress of the current changes in immigration policies.
