Our client first entered the United States in 2000, and over the years, several family petitions were filed on his behalf. In 2004, his father initiated a petition, but it was never pursued further.
Then, in 2011, his mother filed another petition.
Unfortunately, this petition also stalled due to the client’s need to apply for an I-601A waiver, stemming from past issues related to unlawful status.
Despite these setbacks, the possibility of adjusting his status remained within reach, especially as his situation changed.
The client’s adult daughter, a U.S. citizen, became a potential petitioner for him, offering a fresh opportunity to move forward in his immigration journey.
Our firm determined the best course of action was to pursue an Adjustment of Status application with his U.S. citizen daughter as the petitioner.
However, this case presented unique challenges. Since his daughter was born out of wedlock, we needed to provide substantial evidence to establish their parent-child relationship.
We gathered school records, tax returns, photographs, letters of support, and more to demonstrate the authenticity of their bond.
The case was filed in March 2024, and in September 2024, we received an unexpected Request for Evidence (RFE) from U.S. Citizenship and Immigration Services (USCIS).
The notice erroneously requested an I-601 application for a waiver of grounds of inadmissibility, which was not relevant to our client’s case.
We drafted a detailed response to USCIS, explaining why the I-601 waiver was unnecessary and asserting that our client’s status as an immediate relative eliminated the need for such a waiver.
Our persistence paid off. In February 2025, we received the long-awaited approval notice.
After nearly 25 years of navigating immigration petitions, challenges, and delays, our client was finally granted Lawful Permanent Resident status.
This milestone marks the end of a lengthy and challenging journey and the beginning of a new chapter in our client’s life.
