What Should You Do?
So, what should you do if you’re in the United States and want to bring a sick relative here for medical treatment?
B2 Visa
The first way to do this is to get them a medical B2 visa.
You can get this through the DS-160 visa application process online, and embassies are prioritized in these types of interviews. According to the NIH, the B2 visa allows international patients and their caregivers to enter the U.S. and get an extension to their stay if needed.
However, you must be prepared with enough evidence that there is a legitimate medical need for this relative to come to the U.S. So, you have to prove that the relative is legitimately sick, and that they need to get medical treatment for this sickness in the United States because it is unavailable in their home country.
Humanitarian Parole
The second way you can help your sick relative come to the United States is humanitarian parole, which is a process that allows you to apply to USCIS for a period of time that is needed for you to address that medical emergency in the U.S.
The waiting process for this option is long and difficult. A lot pf people wait for a year or longer for a decision to be made on their humanitarian parole application. In addition to long wait times, another setback here is that the standards are very tough to reach.
You will need to provide proof that there is a legitimate and urgent medical or humanitarian reason for you to be allowed entry into the United States for an extended period of time. If you do not have a legitimate, urgent humanitarian reason for the visit, then you will have to go through the normal visa application process through the State Department.
This is why it is important to partner with an experienced immigration attorney who can help you navigate this complex process in order to maximize your chances of success.
Inadmissibility Issues
If your relative has any inadmissibility issues, such as previous visa application denials for serious reasons such as fraud or misrepresentation, or other issues like deportation, they may need a waiver in order to apply for the above options.
In order to see if they are eligible for this type of waiver, you will need to get their case professionally looked at by an experienced immigration lawyer who can determine the best course of action moving forward. Please feel free to contact us for further assistance!
