In September 2023, we had the privilege of meeting a client whose story shows incredible resilience in the face of adversity.
Our client’s parents had already been recognized as victims of human trafficking and were approved for T-1 and T-2 visas.
However, their adult son remained without valid status, and his situation was even more urgent.
His parents were determined to help him gain legal status in the U.S. by filing for a T-6 visa (Derivative child of a family member) based on their approved T-1 and T-2 visas.
The challenges they faced were far from simple. Our client’s parents had been subjected to ongoing monitoring, isolation, and wage theft by their trafficker.
The case was complex.
Although the son had entered legally on a B-2 visa, he had overstayed and accrued unlawful presence.
However, for T visa applicants, overstaying does not create grounds of inadmissibility.
Additionally, his parents’ pending green card applications meant we had to act quickly, as a T-6 application cannot be filed after a T-1 visa holder adjusts to permanent residency.
As we worked with our client to prepare his case, we saw just how much was at stake. In November 2023, after months of careful preparation, we submitted the T-6 visa application.
Fast forward to December 2024, and we were thrilled to receive the news that our client’s application had been approved!
This decision not only secured his legal status but also marked a new chapter in his life—one where he could begin to rebuild, recover, and move forward with hope.
