Stay of Removal Granted Day Before Deportation Flight!

We recently had the honor of representing a client who showed immense resilience after serving a long prison sentence and subsequent challenges with U.S. Immigration and Customs Enforcement (ICE).

Our client was released in September 2023, after serving over two decades in prison.

However, his journey took another twist when he was immediately transferred to ICE custody due to a removal order from 2013.

We had filed a Motion to Reopen and Emergency Stay of Removal with the Immigration Court prior to his release.

However, the court had not delivered a ruling on the motion despite our proactive steps.

On October 24, 2023, ICE informed our client that he was scheduled to be deported to Haiti the very next day.

The reason?

The Motion to Reopen and the Emergency Stay of Removal had been overlooked by the court.

Confronted with this complex scenario, our firm acted swiftly.

We reached out directly to the Immigration Court’s Supervisor and the judge’s clerk, underscoring the urgency of the situation and drawing attention to the overlooked Motion.

One of the pivotal factors in our client’s case was his dedication to personal growth while incarcerated and the successful completion of an outpatient program addressing his substance abuse.

His incarceration record and the pressing nature of his situation resonated with the court.

On the very same day, our Emergency Stay of Removal was granted, putting a pause on the looming deportation!

Our timely intervention and the court’s decision mean that our client can now remain in the U.S. until the Motion to Reopen is finalized.

This case stands as a testament to the impact of precise legal expertise and unwavering persistence.
