After 32 Years in the United States, Haitian Client Gets a Green Card in Two Months

For decades, he lived with the uncertainty that comes with temporary status and periods without immigration status. Today, that uncertainty is something he and his family can finally leave behind.

His Story

Our client came to the United States from Haiti in 1994 on a B-2 visitor visa when he was only about six years old. He was lawfully admitted with an I-94 and remained in the United States ever since.

Over the next three decades, the United States became his home. He eventually married a U.S. citizen, and together they built a family and now have three children.

For years, however, his immigration status remained uncertain. At different points, he had no status, had Temporary Protected Status (TPS), and there was also some uncertainty about whether an immigration filing may have been made for him through his father when he was younger.

Although he was married to a U.S. citizen, he and his wife had not previously filed an immediate relative petition and adjustment of status application because they had been given incorrect advice that they needed to wait two years before filing. That misunderstanding delayed an opportunity to pursue permanent residence.

How We Helped

Our legal team carefully reviewed his immigration history, including his original admission to the United States, his prior TPS history, and any potential issues that could affect his eligibility to adjust status.

Because a successful adjustment of status case involves much more than simply completing forms, we conducted a thorough review for potential grounds of inadmissibility and confirmed that he met the requirements for adjustment of status based on his marriage to a U.S. citizen.

We also carefully reviewed the financial sponsorship requirements and confirmed that his U.S. citizen wife, as the petitioner, met the income requirements for the Affidavit of Support.

In July 2026, we filed the Form I-130, Petition for Alien Relative, together with the Form I-485, Application to Register Permanent Residence or Adjust Status.

Approximately three weeks after filing, our client was scheduled for his biometrics appointment. USCIS then scheduled the couple for an adjustment of status interview at the Holtsville Field Office on September 22, 2026.

The Outcome

On September 23, 2026—just one day after the interview—USCIS approved both the I-130 petition and the I-485 application.

After approximately 32 years in the United States, our client is now a lawful permanent resident in just two months from date of filing.
