After years of uncertainty, a Jamaican client achieved lawful permanent residence with McBean Law’s assistance. Her green card was approved in approximately three months, without a USCIS interview.
Our client is a Jamaican mother who came to the United States on a B-2 visitor visa in November 2021. Although she was lawfully admitted, she remained in the United States after her authorized stay expired and eventually made her home in the Bronx, New York.
She and her daughter consulted with our firm about a year before we ultimately filed her green card application. At that time, however, the daughter had no immediate path to petition for her mother because she was still a lawful permanent resident.
We explained that, unlike a U.S. citizen, a green card holder cannot petition for a parent. We advised the family to wait until the daughter became a U.S. citizen before she could file a petition for her mother.
Sometimes, the right advice is to tell a client they are not eligible yet, explain what must happen first, and be ready to act when the opportunity becomes available.
The family kept that advice in mind and returned to us early this year.
This time, the urgency was greater. Our client’s daughter, who lived in Florida, had joined the U.S. Army and was preparing for military service and possible deployment. The family worried that once her daughter left for military duty, it would become much harder to coordinate signatures, documents, and other requirements needed to file her petition for her mother.
How We Helped
We carefully reviewed our client’s immigration history and circumstances to determine whether she was eligible to adjust status in the United States.
Because she originally entered the United States lawfully on a B-2 visa, we examined whether any inadmissibility or other immigration issues could prevent her from obtaining permanent residence.
We also reviewed the financial sponsorship requirements and confirmed that the petitioner met the Affidavit of Support requirements. Given the daughter’s upcoming military obligations, our team knew that timing mattered.
We worked to prepare the case so the necessary documents could be completed before the daughter became unavailable due to military service. In May 2026, we filed the Form I-130, Petition for Alien Relative, and the mother’s Form I-485, Application to Register Permanent Residence or Adjust Status, concurrently.
Then the approvals started coming.
USCIS approved the I-130 petition in about two months.
Then, a month after the I-130 approval, in August 2026, USCIS approved our client’s I-485.
And there was another welcome surprise: USCIS approved the green card without requiring an interview.
In approximately three months from filing, our client went from having an overstay to becoming a lawful permanent resident.
Today, while her daughter begins a new chapter serving in the U.S. military, her mother begins a new chapter of her own: she is officially a U.S. lawful permanent resident.
