This unfortunate turn of events resulted in the issuance of a Notice to Appear (NTA), bringing our client into removal proceedings and the looming possibility of deportation.
The Immigration Judge denied his Cancellation of Removal application.
In January 2001, he was granted voluntary departure.
The Board of Immigration Appeals later denied his appeal.
Things took a positive turn when our client’s U.S. Citizen son filed an I-130 petition on his behalf, which was successfully approved.
This provided a glimmer of hope in an otherwise challenging situation, setting the stage for a remarkable recovery.
The key to this success story was the dedication of our legal team.
After requesting his records and a thorough case assessment, we determined that our client was a suitable candidate for prosecutorial discretion.
We filed a Joint Motion to Reopen and Terminate proceedings.
The Department of Homeland Security (DHS) granted our request and agreed to terminate our client’s removal proceedings in January 2021!

After years of uncertainty and after our motion to reopen and terminate was granted, we prepared our client’s Adjustment of Status application.
In January 2023, the I-485 Application to Register Permanent Residence or Adjust Status was filed.
The moment we had all been waiting for finally arrived.
Our client’s I-485 was approved in September 2023, making him an official green card holder after a long 34-year journey!
